EULA・利用規約

1. 契約の成立とAppleとの関係

本エンドユーザー使用許諾契約（以下「本EULA」）は、利用者とshameowstudio（以下「提供者」）との間で締結されるものであり、Apple Inc.およびその子会社（以下「Apple」）との契約ではありません。提供者は、本アプリおよびその内容について単独で責任を負います。本EULAは、Apple Media Services利用規約のUsage Rulesと抵触しない範囲で適用されます。

English. This EULA is concluded solely between you and shameowstudio, not Apple. The provider, not Apple, is solely responsible for the app and its content. This EULA applies without conflicting with the Usage Rules in the Apple Media Services Terms and Conditions.

2. 使用許諾

提供者は利用者に対し、利用者が所有または管理するAppleブランド製品上で、Usage Rulesに従って本アプリを個人的かつ非商業的に使用する、限定的・非独占的・譲渡不能・再許諾不能のライセンスを付与します。利用者は、法令で認められる場合を除き、本アプリの複製、改変、再配布、販売、貸与、リバースエンジニアリング、逆コンパイルまたはソースコードの抽出を行ってはなりません。

English. The provider grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the app for personal, non-commercial purposes on Apple-branded products that you own or control, as permitted by the Usage Rules. You may not copy, modify, redistribute, sell, rent, reverse engineer, decompile, or derive source code except where applicable law expressly permits it.

3. アプリの目的と非公式性

本アプリは、職場で用いる日本語を学ぶための教育支援アプリです。本アプリはBJT公式アプリではなく、公益財団法人日本漢字能力検定協会の承認・推奨を受けたものではありません。公式問題・公式音声は使用していません。BJTの名称は、対象となる試験を識別し、学習レベルの参考を示す目的で使用します。本アプリの利用により、特定の試験結果、合格、昇進、採用その他の成果が保証されるものではありません。

English. The app is an educational aid for workplace Japanese. It is not an official BJT app and is not approved or endorsed by the Japan Kanji Aptitude Testing Foundation. No official questions or official audio are used. “BJT” is used only to identify the relevant examination and reference level. No particular score, employment result, promotion, or other outcome is guaranteed.

4. 無料機能とプレミアム機能

無料利用者は、基本問題、練習、単語帳、弱点復習、ブックマーク復習を含むすべての学習機能を利用できます。プレミアムプランの特典はアプリ内広告の非表示に限られます。機能構成は、学習効果、運用上の必要または法令・プラットフォーム要件への対応のため、合理的な範囲で変更される場合があります。

English. Free users may access all study features, including questions, practice, the wordbook, weak-area review, and bookmarked review. Premium is limited to removing in-app advertising. Features may reasonably change for learning quality, operations, legal compliance, or platform requirements.

5. 自動更新サブスクリプション

5.1 プラン情報

• 名称：プレミアムプラン / Premium Plan
• 商品ID：com.yu.bjtbusinessjapanese.premium.monthly
• 期間：1か月
• 日本の予定価格：月額500円。実際には購入確認画面に表示されるApp Storeの価格と通貨が適用されます。

5.2 課金と更新

購入確認時に利用者のApple Accountへ課金されます。サブスクリプションは、現在の期間が終了する24時間以上前に利用者が解約しない限り、同じ期間で自動更新されます。更新料金は、現在の期間終了前24時間以内にApple Accountへ請求されます。価格変更が行われる場合、Appleの手続および適用法令に従って通知または同意取得が行われます。

5.3 解約・管理・復元

利用者は、端末の「設定」からApple Accountの「サブスクリプション」を開くか、アプリ内の「サブスクリプションを管理」を使用して、更新の停止またはプラン管理を行えます。解約しても、現在の支払済み期間の終了までは特典を利用できます。機種変更または再インストール後は「購入を復元」を使用できます。

5.4 返金

支払い、請求および返金はAppleが処理します。返金の可否は、Appleのポリシーおよび適用される消費者法令に従います。提供者は、Appleに代わって返金を実行できません。

6. 利用者の責任と禁止事項

利用者は、適用される法令および第三者との契約条件を遵守して本アプリを利用するものとします。利用者は、不正購入、購入情報の改ざん、セキュリティ機能の回避、アプリまたは広告配信への妨害、第三者の権利侵害、違法・有害な目的での利用を行ってはなりません。

English. You must comply with applicable laws and relevant third-party terms. You may not engage in fraudulent purchases, tamper with transaction information, circumvent security, interfere with the app or ad delivery, infringe third-party rights, or use the app for unlawful or harmful purposes.

7. データとプライバシー

データの取扱いは、別途定めるプライバシーポリシーに従います。学習進捗、ブックマーク、表示言語およびBGM音量は原則として端末内に保存されます。広告配信にはGoogle Mobile Ads SDKおよびUser Messaging Platformを、購入処理にはApple StoreKitを使用します。

English. Data processing is described in the Privacy Policy. Learning progress, bookmarks, interface language, and BGM volume are generally stored locally. The app uses Google Mobile Ads and User Messaging Platform for advertising and Apple StoreKit for purchases.

8. 外部サービス

本アプリはAppleのApp Store、サブスクリプション管理、Googleの広告・同意管理等の外部サービスを利用します。外部サービスの利用には各提供者の利用規約およびプライバシーポリシーが適用されます。提供者は、外部サービスの停止、仕様変更または利用不能について、提供者の合理的支配を超える範囲では責任を負いません。

English. The app uses external services including Apple’s App Store and subscription management and Google advertising and consent services. Their terms and privacy policies apply. The provider is not responsible for outages or changes outside its reasonable control.

9. 保守・サポート

本アプリの保守およびサポートについては、提供者が単独で責任を負います。Appleは本アプリに関する保守またはサポートを提供する義務を負いません。お問い合わせは本ページ末尾の連絡先へお願いします。

English. The provider is solely responsible for maintenance and support. Apple has no obligation to provide maintenance or support for the app. Contact the provider using the details below.

10. 保証の否認

適用法令で許容される最大限の範囲で、本アプリは「現状有姿」かつ「提供可能な範囲」で提供されます。提供者は、内容の完全性、正確性、継続提供、特定目的への適合性、無停止または無誤謬を保証しません。適用法令により免責できない保証については、その法令が優先します。本アプリが適用される保証に適合しない場合、利用者はAppleへ通知し、Appleは適用される範囲で購入価格を返金することがあります。Appleは、法令上許容される最大限の範囲で、それ以外の保証義務を負いません。

English. To the maximum extent permitted by law, the app is provided “as is” and “as available,” without warranties of completeness, accuracy, continuity, fitness for a particular purpose, uninterrupted operation, or error-free operation. Non-waivable statutory rights remain. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price where applicable; to the maximum extent permitted by law, Apple has no other warranty obligation.

11. 責任の制限と製品に関する請求

適用法令で許容される最大限の範囲で、提供者は、間接損害、特別損害、付随的損害、結果的損害、データ消失、逸失利益または試験・就業上の結果について責任を負いません。ただし、提供者の故意または重過失、その他法令上制限できない責任には適用されません。本アプリ、利用者による保有・利用、製造物責任、法令適合性、消費者保護またはプライバシーに関する請求への対応は、Appleではなく提供者が責任を負います。

English. To the maximum extent permitted by law, the provider is not liable for indirect, special, incidental, or consequential damages, lost data, lost profits, or examination or employment outcomes. This does not exclude liability that cannot legally be limited, including intentional misconduct or gross negligence where applicable. The provider, not Apple, is responsible for claims relating to the app, possession or use, product liability, legal compliance, consumer protection, or privacy.

12. 知的財産権

本アプリのプログラム、オリジナル問題、文章、デザイン、キャラクターおよびその他のコンテンツに関する権利は、提供者または正当な権利者に帰属します。第三者から、本アプリまたは利用者による本アプリの利用が知的財産権を侵害すると主張された場合、その調査、防御、和解および解決については、Appleではなく提供者が責任を負います。

English. Rights in the software, original questions, text, design, characters, and other content belong to the provider or their lawful owners. If a third party claims that the app or its use infringes intellectual property rights, the provider, not Apple, is responsible for investigation, defense, settlement, and resolution.

13. 輸出・制裁法令の遵守

利用者は、米国その他の適用される輸出管理および制裁法令に違反して本アプリを輸出、再輸出または利用しないことを表明します。利用者は、禁輸対象国に所在せず、米国政府の禁止または制限対象者リストに掲載されていないことを表明します。

English. You represent that you will not export, re-export, or use the app in violation of United States or other applicable export control and sanctions laws, that you are not located in an embargoed country, and that you are not on a prohibited or restricted party list.

14. 契約の終了

本EULAは、利用者または提供者が終了させるまで有効です。利用者が本EULAに違反した場合、使用許諾は自動的に終了することがあります。終了後、利用者は本アプリの使用を中止し、端末から削除するものとします。サブスクリプションの解約は、第5条の方法で別途行う必要があり、アプリ削除だけでは自動更新は停止しません。

English. This EULA remains effective until terminated. The license may terminate automatically if you breach it. After termination, stop using and delete the app. Deleting the app does not cancel a subscription; cancellation must be completed as described in Section 5.

15. 準拠法・消費者の権利

本EULAは、抵触法の原則を除き、日本法を準拠法とします。本EULAに関する紛争については、適用法令で許容される範囲で東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、利用者の居住地で適用される強行的な消費者保護法令に基づく権利を制限するものではありません。

English. This EULA is governed by the laws of Japan, excluding conflict-of-law rules. To the extent legally permitted, the Tokyo District Court has exclusive first-instance jurisdiction. Nothing limits mandatory consumer rights under the law of your residence.

16. Appleの第三者受益者

利用者と提供者は、Appleおよびその子会社が本EULAの第三者受益者であり、利用者が本EULAに同意した時点で、Appleが第三者受益者として本EULAを利用者に対して執行する権利を有することを認め、同意します。

English. You and the provider acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, Apple has the right to enforce this EULA against you as a third-party beneficiary.

17. 規約の変更

提供者は、法令、サービス内容または外部サービスの変更等に対応するため、本EULAを改定することがあります。重要な変更は、アプリ内またはウェブサイト上で合理的な方法により通知します。改定後も本アプリを継続利用した場合、適用法令で別途同意が必要な場合を除き、改定後の規約に同意したものとみなされます。

English. The provider may revise this EULA to reflect legal, service, or external-service changes. Material changes will be communicated reasonably in the app or on the website. Continued use after the effective date constitutes acceptance unless applicable law requires separate consent.

18. 提供者・連絡先
